Kerrick - Ferrell The Last Act

Then there is this, the distilled version of the last act, that most the world understands regarding Charlotte's Kerrick - Ferrell encounter.

 — The white Charlotte police officer whose trial in the shooting death of an unarmed black man ended with a deadlocked jury has resigned from the force and reached a settlement with the city, officials said Thursday.

Randall Kerrick resigned from the Charlotte-Mecklenburg Police Department effective Oct. 2, the officials said in a statement.

Kerrick will receive almost $113,000, subject to taxes and standard deductions. The city will pay just over $50,000 to the attorney who represented Kerrick in the civil suit brought against him by the family of Jonathan Ferrell. The city reached a $2.2 million settlement with Ferrell's family in May.

But the statement said Charlotte will not pay any legal expenses for Kerrick's criminal defense. The agreement, which officials said contains no admission of fault or liability, includes a release of all potential legal claims.

George Laughrun, who represented Kerrick in his trial, did not return a telephone call seeking comment Thursday.

Kerrick was charged with voluntary manslaughter in Ferrell's death. Police say Ferrell crashed his car on the morning of Sept. 14, 2013, and went to a nearby house and banged on the door, apparently seeking help. The resident called police, and three officers responded. Investigators say one deployed his Taser without apparent effect on Ferrell before Kerrick fired 12 shots, 10 of which hit him.

Kerrick testified that he repeatedly fired because Ferrell kept charging at him and he didn't think his weapon was even working.

Prosecutors said nonlethal force should have been used to subdue Ferrell, a former Florida A&M football player. Kerrick's attorneys said the officer feared for his life when he shot and killed Ferrell while responding to a breaking-and-entering call.

Despite calls for prosecutors to retry the case, North Carolina Attorney General Roy Cooper announced that the state would not seek a new trial for Kerrick.

And now CP's final take:

Charlotte and CMPD have moved on from the Kerrick-Ferrell shooting but the department needs to address the real issues behind what happened.

A good start would be to counter “tunnel vision, audio exclusion, time dilation” and the panic stressors that cloud officers ability to process vital info when under attack. This means revised training programs and turning the academy into something more than the android like cop producing factory it has become.

And that means spending taxpayer dollars in a wise and sensible manner.

Rodney Monroe spent your tax money on what pleased him, shiney bight new toys and gimmicks not real life training, not live fire, active shooter, shoot dont shoot training. 

But training alone won't fix what is wrong. Somehow we need to unwind the perception that Jonatgan Ferrell was a victim.

The amount of damage that has been done is astounding. Officers are now high profile targets, as the likes of Al Sharpton and Rodney Monroe have time and time again reaffirmed the hands up don't shoot myth.

I know CMPD Officers who have turned in their NCDMV  law enforcement and FOP plates, even going as far as removing the thin blue line plates from their personal cars. 

Having a marked take home car just isn't as attractive as it once was. 

The perception us that challenging cops is your right, even if you end up dead is just all kinds of stupid, but is continuly promoted.

Sadly the thugs and hood rats will become more violent with even less common sense or rational thinking. 

Until politicians and the African American community get behind LE and starts saying "point a fake gun at a cop you are going to die, charge at a police officer and your going to die" we will continue to loose the battle. 

Until police chiefs like Rodney Monroe let the public know "we aren't going to automatically blame the cop just because we don't want y'all acting up", we are going to have more of these officer involved shootings that could have been avoided.

The Observer's article was piss poor and a travesty to boot. The quotes from Ferrell's mother were absurd and continue the the narrative. The public is being held hostage by the media and fed ridiculousness. Utter ridiculousness.

So a career is ruined and Kerrick gets a couple years back pay and legal fees in return. Ferrell's mom gets 2.2 million, and still gets treated as a credible source by the media when she says "My baby didn't do nothing, and he was murdered." Just lovely.

All these "hands up don't shoot" myths, the assumption that police are racist and in the wrong during a contact, and the fact that people in society think they are all somehow special, the rules don't apply to them, and that all situations are negotiable will result in more people getting killed.

I have a friend of a friend who recently initiated a traffic stop in Eastern NC. Standard stop, resulting in a ticket. Once he got to the occupants and got ID, he said "I'll be back in a minute, just stay in the car for me." What did they do? They got out, put their hands up and started marching backwards chanting words I don't have to mention for you to know.

Leaders in certain communities are preaching this is the right thing to do. You get into a dangerous situation like a traffic stop, and people want to play games, make a political statement, etc. Then when someone gets shot or thumped on the head for non-compliance, those same leaders cry "racism," "murderer," and will not accept their responsibility in the matter.

It almost makes you think that these leaders will sacrifice some of their own to undermine the legitimacy of local police--possibly in favor of a national system.

CP, thanks for bringing up officer safety, especially off duty in your write up. Everyone should be thinking of ways to blend in more.

And while all this is going on not once does the Chief or his merry band of white shirts come to any rolls calls and say "we have your back, don't worry this too shall pass".

No, instead they dole Out a new schedule for the officers that screws everyone up, totally screws up shift integrity and basically gives zero reason as to why and how they came up with this plan. The transition team is a joke and no one really know what they do and how their decisions that are supposed to "better the department" are made.

But, at least all the brass will still be able to work the comfy off duty gigs at the Panthers games and do nothing while arriving late and leaving early.

Perhaps the transition team can come up with ways to boost morale rather than break it down and have officers down in the dumps

Minutes from the closed session meeting are partially redacted, but the CO reports that Kerrick's attorneys indicated CMPD and the City of Charlotte violations of the CMPD Internal Affairs Policy... surprise. Big surprise they didn't want any CSB hearing or civil trial over this--

That would have exposed the mountain of covering up in Internal Affairs by Cam Selvey, Rodney Monroe, Roz Maglione and others. Then the City would be held responsible for fostering police misconduct by many members and by the Chief and others with big paychecks.

This kind of malfeasance is a public safety issue and affects officer safety and it must be addressed. But if people continue their silence on these issues, it will continue.

I knew the payout was low, but given 8:43's comments I now know it was way low. They probably brought out the "well we reserve the right to refile charges in the county, even though the AG has no interest...so weigh you and your family's options, son." After all Wes has been through, it is no wonder they bit. That happened to another buddy of mine, though his was a threat of charges after a clearing and a firing for PR's sake.

Both a win and a loss for the taxpayer. Huge loss for Wes. Huge loss for all field officers.

Enjoy retirement Rodney...get nice and fat off of that pension. By that I mean high blood pressure, diabetes, heart attack, stroke, early death and meeting your maker for what you did as soon as possible.

Cam Selvey and Roz Maglione should take a copy of everything ever started and every email or note they made about being ordered to bury investigations or to railroad an innocent officer (AND SHAMEFULLY AND ILLEGALLY FOLLOWED THOSE ORDERS) and get an attorney to expose them to the public immediately.

Anyone involved in training who has information about the lying act put on by Campagna under oath at trial should do the same. Before he goes to work for Coca Cola. The obvious lies and complete disarray and incompetence by the former Chief and his suckups needs to be exposed.

Settling to cover up a cover up... and look at all the lives destroyed or just ruined.

Putney could clear his conscience and open his mouth. But he won't. Because he's not an ethical leader.

We are told accountability and transparency is what is expected but the white shirts have none. We are told they value there employees but they will fire you when they are wrong. We are expected to be loyal yet never expect that in return. There is nothing left at CMPD. The command staff has perpetrated fraud upon the officers and civilians of Charlotte. The leadership is atrocious and vile. The citizens will suffer as more shootings and murder run rampant as a result. Who in their right mind would police knowing damn well they are not protected by anything but body armor. For what? 58 grand a year? Uh no thanks but I was also too damn white and on way too long to get a take home car. Putnay can kiss my beautiful rosey Irish ass! Oh, I'll have some pie now

12:22...Thanks for putting it out there. I was one of the railroaded officers around the time of the Cpt. Adkins fiasco who was not given the ability to go before the Civil Service Board for a year, resulting in my eventual resignation due to hardship - just what they wanted.

Public Safety leadership in Charlotte is in major need of fixing. I read all of the comments and it is no different than what you hear from firefighters. Lying, made up rules based on who your dealing with and a Civil Service Board that has been infiltrated by Police and Fire top officials. It's time to stop the bleeding. We need Leadership from outside this City. Not because they are smarter but because they will hopefully have the nerve to bust up the promotion to my buddy give away program and actually fix something. Maybe it's time for a Public Safety Commission appointed by Council and they hire and fire the Chiefs. Nothing is getting done in its current format for sure.

Looks like Putney is begging for more police officers! Wonder why?
Police are resigning in large numbers due to the extreme distrust with administration ( the ones who dress in white look like cops but are useless ass clowns that should have been terminated after causing such a mess)
