Why Spencer Merriweather Fails Us

In the criminal justice system, the people are represented by two separate, yet equally important, groups: the police, who investigate crime; and the district attorney blah blah blah .....

 

 

Tell that to last week's road rage victim who was laid out on the pavement by Demont Forte after he rammed her car on I-85 and followed her onto Beatties Ford Road. 

Forte, the suspect in that attack is so well known to CMPD that they wasted no time in locating and arresting him. 

The CMPD police report indicates that the incident happened around 1 p.m. on Wednesday, April 7. The video shows the assault victim driving a silver vehicle down I-85 with a white car following close behind. Both drivers weave in and out of traffic before exiting the highway.

The drivers then pull off into an Exxon gas station parking lot at 2519 Beatties Ford Road. Demont Forte the man driving the white vehicle exits his car as does the woman who seems to be asking why are you doing this?, as Forte rears back and clobbers her with a closed fist hitting the woman in the face knocking her to the ground. The force of the blow so severe that it literally knocked her out of her shoes. 

But the CMPD report writes the entire terrifying event up as just a minor altercation all misdemeanors.

Forte was taken into custody that day. He was released from jail about 14 hours later. He’s facing charges of assault with a deadly weapon (car), assault on a female and hit-and-run.

Forte is no stranger to CMPD as he has been involved in cases where women were harmed before. 
 According to CMPD, he was arrested for murder in April 1992 for which he was  convicted of manslaughter and sentenced to probation. 

His criminal history continued after that with several drug arrests and then in 2005 he was convicted under the state's habitual felon law and sentenced to 6-8 years. He was released from prison in 2011.

But his life of crime didn't stop once he returned to Charlotte. 

In 2017, Forte was arrested following a SWAT standoff. At the time, he was wanted on outstanding warrants for felony breaking and entering, assault and communicating threats. He refused to come out of his house and SWAT had to force their way inside, eventually taking him into custody. Those charges were dismissed.

In May of 2019 he was arrested again on drug and weapons charges:

Misdemeanor- Carrying Concealed Gun

Misdemeanor - Possession Drug Paraphernalia

Felony - Possession Stolen Firearm

Felony - Possession with intent to manufacture/sell/distribute Methamphetamine

Felony - Possession with intent to sell or distribute Cocaine

Felony - Possession Firearm By Felon

The case had been postponed due to COVID-19. 

But while out on a minimal bail Forte continued his crime spree.

He was arrested in January 2020 for assault on a female, false imprisonment and fleeing to elude arrest. He was later arrested in September 2020 and once again charged with assault on a female and assault with a deadly weapon causing serious injury.

For some reason Mecklenburg County DA Merriweather refuses to seek to have Forte's bail revoked. 

And now this attack on another woman.

The 2019 charges are on the docket for next Monday Mecklenburg Superior Courtroom 5310.

Forte will be represented by Denzil Forrester. The people (that's us taxpayers) will be represented by the DA's habitual felon team. 

But it is doubtful the ultra liberal Judge Bell has the scones to hold Forte over for trial and revoke his bail and the DA's team is made up of 3 first year rookie criminal lawyers. Four CMPD Officers are on the docket as well.

Lets not get so quick to blame Mayweather. The magistrates, the jail, and the cmpd are all to blame for this type of nonsense. The DA can only do so much with what they got going on over there. The cmpd has their fair share of let downs and whoopsies.

I was part of the 2017 case the ADA who was Merriweather then dropped the ball. Forte walked because of the habitual felon team. Six Officers show up and the ADA is MIA. My money say Forte walks again. Just saying.

Sorry Cedar you can’t blame this all on Merryweather it’s more the magistrates and Covid-19 protocols that are in place. My wife is FED paralegal and it’s very frustrating that these people get out with no bail and return right back. You have to commit a very serious crime like murder or 2nd degree Murder for them to revoke your bond out here. All these petty crimes are on the back-burner no wonder he got out 14 hours later...

The big difference is with Andy Murray as DA he didn't mind the hard work long hours, Merriweather however is a slacker he's not the Law & Order type working around the clock to get a solid airtight case. He works about 30 hours a week and heads home. If a case doesn't look perfect he blames investigations and punts. Every freaking time.

If there is going to be a discussion about removing immunity from anyone, it needs to be from the judges and prosecutors. The immunity for police is already limited in scope, but there is no accountability whatsoever for judges and prosecutors when they let someone walk and that person goes out and continues to victimize innocent people. One huge issue is the campaign contributions for judges coming from defense attorneys. No one pays attention to local and state elections for judicial candidates, and certainly very few private citizens are actually donating to their campaigns. This issue will only be fixed by private citizens waking their sleepy asses up and electing new officials from the local level all the way up to the White House, if there’s any actual integrity left in the election. I sure do wish that lady had been a concealed carry citizen though. She would have ridden the taxpayers of a real shitbird.

Anyone see what the great state of California is doing? They’re looking to “dismantle racism in mathematics”. There is no hope for this country. When they’re making something that was never considered racist until 2021 racist there is a problem. Are they suggesting that perhaps because most black people can’t understand math because they’re dumb therefore it’s racist? Why isn’t there a huge outcry from the black community? It’s the same with this whole voter ID laws. They’re suggesting blacks are too dumb to obtain an ID and the sheep just go along with it and nod their heads. I say there is no hope for this country because if you are white, you are automatically racist because of the pigment of your skin. Makes sense don’t it? 2+2= 4 NOPE. 2+2 = whitey is racist.

The system is totally trucked up! Liberals and turned Meck County into a joke. There is zero reason to release violent offenders pre-trial. They re-offend 100% of the time before they even go to trial. The political process has put every citizen of Charlotte regardless of skin color or political party at risk.

This is 100% the DA and Magistrates, and courts. Cops arrest him, the Sheriff holds him in jail...until the magistrates, DA and courts set him free.

The cops and Sheriff (Executive Branch of Government) are doing their job, but the Judicial Branch (the DA, courts and magistrate) are not.

It looks as though the best thing that could happen is some law abiding person run into him and solve this with a Second Amendment Solution.

CMPD sends over so many shotty cases and you have no idea what some of these cops look like when the prelim discussion is conducted. The DA just wants to use his resources in a constructive manner and not waste everyone's time with a cocaine case from a 24 year old rookie with a stuttering problem.

11:50 you are an idiot and the DA is a sad joke. There's no reason Forte should be on the streets. If Merry Fucking Poppins can't do the job she needs to resign or hand the case off to the Feds.

Liberal fools like you crying about long hours and case load are the reason we had over 100 homicides last year 99% of those murders were avoidable had the DA and I'll assume others in the office like you did their jobs.

You are why in each case either vic or the perp had priors that in another other district would have seen them locked up.

Anyway, WHY in fuck did she get out of her car???? Pull over at the Exxon. Wait until HE gets out and just before he gets to your car, take the fuck off. Maybe you'll lose him. You'll at least get a head start. If that doesn't work. Rinse.....lather......repeat.

But getting out of your CAR? Stay in it, windows up, doors locked. ESPECIALLY if you're a woman.

Tired of the DA bashing. Ya they suck but the judges are the ones giving the lightest possible sentences and letting defense attorneys play games in the court room like when we all get subpoenaed and all show up they let the defense attorney get “just one more continuance” so we all have to show up again. Then one of us is on vacation the next time and the defense attorney raises hell that we are preventing their client from getting a speedy trial. If you haven’t had that happen to you at least 3 times you’re a rookie or suck at your job. It’s law school 101 shit.

Lest we forget that most of patrol can’t investigate its way out of their patrol car with the window open. The amount of times I’ve sat outside the papering office door listening to some ADA explain basic investigations to some 3000 code number is pathetic. You’re 3 line victims statement is useless and you can’t use it in court if the victim doesn’t show up. A good investigation should take more than 13 minutes. The more we run like scalded dogs from call to call, the less likely the city is to realize we are short staffed and get fed up with the city “leadership” and run away crime.

It is a bit difficult for CMPD to blame the DA for dismissing cases (to have a higher conviction rate)when CMPD is reducing violent crimes down to simple assaults to keep the violent crime rates down. Also reducing crimes allows the DA to dismiss cases reported as minor offenses a lot more easily. Pot meet kettle! This has been going on for years. Refusing to report crimes accurately and dismissing cases is one of the reasons Charlotte is in this mess right now. Please report crimes accurately or things will only get worse.
