Charlotte Firefighter Will Not Be Charged In Shooting Death

FOX News Charlotte is reporting that the Mecklenburg County District Attorney’s Office and CMPD have determined that no charges will be filed against the off-duty firefighter involved in this shooting and that his actions did not rise to the level of criminal conduct in the death of James David Lambert.

Lambert

During the course of the investigation CMPD detectives determined that the resident positioned himself between his car and the truck Lambert was operating in an attempt to detain Lambert until police arrived.

Evidence gathered indicated that Lambert accelerated his vehicle in the direction of the property owner presenting a reasonable fear of imminent death or serious bodily harm to the off-duty firefighter.

More details from FOX News Charlotte here.

Lambert had recently been arrested on charges consistent with domestic violence, including assault on a female, interfere with emergency communication, communicating threats and false imprisonment.

Cedar,
There is a lot more to this than meets the eye.

Do you not think they reached this "decision" pretty quickly?

I mean, the ink is not even dry on the statements taken.

Was a thorough investigation even done?

Was the guy really "stealing" the trailer?

This is just another time that Rodney is thumbing his nose at rules, regulations, proper procedures, LAWS, investigations and being the "decider".

The man has textbook arrogance and ego....now he is becoming judge and jury...and the DA is going along with him.

Do you think it is because the guys a fireman?

Due process, seriously........

I don't care if the guy was a scum bag.....This needed, demanded, a MUCH more thorough investigation.

This is more of Rodney's absolute Bullshit, Chickenshit, corrupt quid pro quo corrupt decisions.

EPIC FAIL, and wrong, once again, on many levels.

And I guess this doesn't "count" as a homicide?

He really has found a way to "hide the bodies"

What a blatant travesty.

At this point, I could care less if the guy was a fireman or not! I am sick of thugs getting off and we citizens being setup as their targets! ONE down and million more to go....

And vigilante justice is all good in Charlotte!

I would like the NAME of the person that decided not to bring charges. And why a more thorough Investigation was not done.

And when the firefighter was standing in front of the truck, was he pointing a gun at the guy in the truck? Is a firefighter a cop? Shoudn't the firefighter have called the POLICE?

WTF?

This is bizarre, a does not pass the bullshit test.

Monroe has nothing to do with whether or not murder charges are being filed. The Homicide Unit will make that determination based on the information they have. The news said the district attorney's office responded to the scene.

So Anon 10:28pm, you really think the white guy is driving the black guy's trailer down the street at 11:30pm because he isn't stealing it? Especially when he has a record of stealing stuff. And his partner was there and was also arrested for stealing it.

I think they made the decision based on all the evidence they have. If some new information comes along, they can always file charges later.

Hmmmm, could he have moved out of the way of the truck or did he put himself in that position? I think it's great. Just remember this case when the next police officer fires at a moving vehicle when he feels his life is in danger!

Are you really kidding me?

The Homicide Unit made the decision??

O,d Ridny makes ALL the decisions at CMPD, he OWNS
IA as he OWNS Homicide....so I imagine he and his buddy, Rudy, made this decision nd TOLD others eat the outco e was.

Give me a break, that was a good one, Homicide made the decision, had a good laugh with that one.

Rodney just tells all what outcome he wants, and right or wrong, legal or not, he gets what he wants.

He does the same with City Council and the DA.

CORRUPT, that's how he rolls up in those new offices.
