Citizens Review Board Wants Subpoena Power Charlotte FOP Lodge 9 Objects

On 3/31/2021, CMPD Chief Jennings spoke with WSOC-TV reporter Glenn Counts regarding subpoena power for the Citizen’s Review Board (CRB).

This Bill has been introduced in the NC General Assembly under SENATE BILL DRS45115-ND-60A*. 

Particular interest is this bill states:

If a person fails or refuses to obey a subpoena issued pursuant to this subdivision, the Board may apply to the General Court of Justice, Superior Court Division, for an order requiring that the subpoena be obeyed, and the court shall have jurisdiction to issue the order after notice to all parties. 

The City of Charlotte describes the CRB as serving only in an advisory capacity to the Chief of Police, the City Manager and the City Council. The CRB itself cannot take disciplinary action against a police officer or award damages to an injured citizen. The CRB only can advise the Chief of Police and the City Manager when it becomes clear to the CRB that the disciplinary decision of the police department was a serious mistake.

Compelling officers and citizens to testify in non-criminal matters, especially to an "advisory" board sets a dangerous precedent. This Lodge, along with CMPD Officers, have continuously asked Chief Jennings to create morale-boosting improvements but requests are denied. This is an additional blow to officer welfare.

The Fraternal Order of Police, Lodge #9 has always been open to fairness and working to build trust in our communities. However, using courts to compel officers to testify in non-criminal matters is something we firmly oppose. It's time the department stands to protect officer’s civil rights, as they do to protect those of Charlotteans.

FOP Lodge 9 will meet tomorrow night to discuss this mater and other items.

But concerns with the CRB doesn't stop there. 

The board is hardly the non-partisan oversite advisory board it was originally supposed to be. It has become a legalized officer lynch mob filled with not citizens, but rather wackivists intent on defunding the police and punishing CMPD Officers with a vengeance.

A review of public voting records show every one currently serving on the board is a registered democrat. 

The majority of the board is African American. Hardly embracing diversity. Hispanic and Asian communities have zero representation.

But let's look deeper:

According to Charlotte.gov the following rules apply to all board members:

All applicants must be a registered voter in Mecklenburg County.

Current and former City employees, and the spouse, parents, and children of a current or former CMPD officer, shall not be eligible to serve on the board.

Nominees are subject to a state criminal background check.

Individuals with a felony conviction or Class A1 misdemeanor conviction shall not be eligible to serve. Individuals with a Class 1 or Class 2 misdemeanor conviction within 3 years of their nomination for appointment shall be ineligible to serve.

Members must be continually domiciled within Mecklenburg County and be registered to vote within the County.

All board members shall attend and successfully complete the Charlotte-Mecklenburg Police Department's Citizens Academy and receive training on relevant legal and policy issues as required by the City Manager. This training must be completed prior to any board appointee serving as a member of the board.

Candidates for the board may be interviewed by a panel comprised of a representative from the Community Relations Committee, the Citizens Review Board and the City Manager's Office to assess core characteristics necessary to serve on the board.  Such panels shall provide their assessments to the relevant appointing authority.

Each member of the board shall participate in at least eight hours of training each calendar year, which training may include a four-hour "ride-along" with a CMPD officer.

Appointees are subject to City Council's Attendance and Anti-Harassment Policies.

Appointees are subject to the Code of Ethics, Gift Policy and Disclosure Requirements for members of boards and must file a Statement of Economic Interest by February 1st each year.

Appointees must sign and adhere to a confidentiality agreement.

Appointees serve on a voluntary basis without compensation.

Cedar's Take:

At odds with common sense is the revised wording that allows the "chair" to  subpoena a witness or to "compel" production of evidence. Allowing one person, in this case Tonya Jameson the power to force a CMPD officer to produce his/her personal cell phone records as an example, is pretty troubling.   

 

In the conduct of evidentiary fact-finding proceedings, any of the following may 
subpoena witnesses and compel the production of evidence: (i) the chair, (ii) 
the vice-chair when acting in the absence of the chair, and (iii) a majority of 
the members of the Board. If a person fails or refuses to obey a subpoena 
issued pursuant to this subdivision, the Board may apply to the General 
Court of Justice, Superior Court Division, for an order requiring that the 
subpoena be obeyed, and the court shall have jurisdiction to issue the order 
after notice to all parties.

It’s incredibly disappointing to have so much time left till retirement and see the depths to which things are sinking with this organization. For an entire list of morale boosting suggestions by the FOP to the chief to be shit on so cavalier is just another kick in our shriveled up nuts. My favorite is the counter to the vest request about how their are other studies which cite how they’re bad for your upper back. Well fuck me, cause there are studies showing how bad for your health wearing a mask is, so I think I’ll just go along with that study instead. This city is facing record breaking violent crime and yet the priorities are on uniform appearance and professional standards’ body camera threats. They have the authority upstairs to unleash absolute hell on violent repeat criminals, but according to the chief, the only way to curb violent crime like the 7 year old girl being shot is to engage in community outreach. FUCK I can’t retire fast enough.

We are heading into our second straight record-breaking year of violence with officers working an overwhelming load and we can’t even get the slightest consideration of a simple request like an outer vest carrier. If the outer carrier is such a safety risk, then why do POB officers wear them in the middle of a riot when they are more likely than ever to be grabbed by suspects? Furthermore, please show me the research that’s says these vests are more detrimental to health that duty belts. These suggestions all just sound like excuses coming from the authoritarian-led command staff in the Chief’s office. I am truly sickened by this so-called “leader”.

I work in the police attorney's office and I would like to offer you all a challenge to some of your views and false claims.

First, there are reasons why qualified immunity should be eliminated. Many officers are poorly trained and do not maintain a professional standard. They do not deserve protection by the city and police department's legal teams. Our time is valuable and we have a plethora of cases to focus on at any given moment.

Secondly, many officers feel that they are above the law that they swore an oath to serve. It makes us sick when we review some of these body cameras and observe the horrific findings. Focus your observations within your own teams, and you will have less to speak about on this highly scrutinized blog site.

Finally, we have applied many approaches to the matter of subpoena powers to the CRB. We truly value the thought and ideas of our citizens, because they are the reason that we are here and happily employed. The CRB is fully capable of drawing their own conclusions and judgements about the actions, behaviors, and statements that our guardians are completing on a daily basis. Please show the CRB a level of respect for their service to the community at large.

Sometimes, it is better to speak less than to speak more. Your thoughts and views may not be as important or socially acceptable as you believe they are.

Wow, if 1959 is a staffer at the police attorney, I wouldn't bother showing up for my next shift. Typical govco employee though, blame the police for not maintaining a standard because these cases take up their 'valuable time'. You realize that the training is the responsibility of an organization, not the individual who works in the organization, right? That maintaining a standard comes from upper leadership. When you hire folks who lie about their educational background, why would the ranks maintain a higher standard than the leader? When the city is run by literal criminals (see Patrick Cannon for example), why would those brave enough to keep the citizens safe feel compelled to hold a higher standard?

You're right, the loan was for approximately $400,000. Mortgage companies primarily focus on risk evaluation when deciding whether or not to approve a loan.

The house was built recently, so if that's old to you, so be it.

But let's get back to the primary issue at hand, which is the removal of qualified immunity, none of us should be willing to risk what we've worked hard for because of the Marcus Jacksons of CMPD.

Here's a hypothetical scenario if qualified immunity goes away:

Officer stops vehicle and issues traffic citation to driver for speeding.
ADA dismisses traffic citation outright.
Driver files a civil suit against Officer for 4th Amendment violation - illegal seizure.
Officer forced to settle out of court or take chances in civil court.

Does anyone think this is a good idea?

This officer violated the dept use of force policy and laws governing use of force and will not qualify for immunity. Granted, the officer doesn't have any money, the dept does. That is why they will focus on lack of training of something to put blame on the PD.
